Contrat de bail : \u00e9crit et clair.<\/h2>\n<ul>\n<li>Un <em>contrat priv\u00e9<\/em> ET un <em>contrat officiel administratif<\/em> pour pr\u00e9sentation aupr\u00e8s de l\u2019administration comp\u00e9tente, sign\u00e9 par toutes les parties.<\/li>\n<li>Un <em>\u00e9tat des lieux descriptif <\/em>(des moindre irr\u00e9gularit\u00e9s, tel un cable qui sort d\u2019un mur, des traces d\u2019usure de la peinture dur les portes, etc), des photos de l\u2019\u00e9tat g\u00e9n\u00e9ral et des types d\u2019irr\u00e9gularit\u00e9s.<\/li>\n<\/ul>\n<blockquote><p>Je recommande vivement au locataire d\u2019exiger une<em> \u00ab Copia Simple\u00a0 del Registro de la Propiedad\u00bb<\/em> actuelle (valeur 3 mois) de la propri\u00e9t\u00e9 de la maison\/appartement et ainsi <em>v\u00e9rifier<\/em> si la personne qui dit \u00eatre le propri\u00e9taire l\u2019est bien, mais <em>que tous les propri\u00e9taires se retrouvent dans le contrat et signent celui-ci<\/em>. <strong>Vous \u00e9viterez des fraudes multiples non peu habituelles.<\/strong><\/p><\/blockquote>\n<h2>2. A la sortie et \u00e0 la remise des clefs :<\/h2>\n<ul>\n<li><em>\u00a0Autre \u00e9tat des lieux <\/em>\u00e0 contraster avec le premier <em>remise des clefs en \u00e9change de remise de la garantie<\/em> du deuxi\u00e8me mois, sauf si d\u00e9g\u00e2ts \u00e0 estimer.<\/li>\n<li>La remise de la garantie obligatoire d\u2019un mois se remet par la suite en g\u00e9n\u00e9ral et couvre les frais de distribution d\u2019eau, \u00e9lectricit\u00e9 qui correspondent au mois en cours. La raison \u00e9tant que les factures doivent \u00eatre pay\u00e9es par qui correspond. Ici le document de remise des clefs doit inclure l\u2019incorporation (\u00e0 la main souvent) de la lecture des compteurs.<\/li>\n<\/ul>\n<h3>Point sp\u00e9cial propri\u00e9taire :<\/h3>\n<ul>\n<li>Pr\u00e9voir (et ce dans ses frais \u00e9galement) le changement de serrure des portes de la propri\u00e9t\u00e9 \u00e0 chaque changement de locataire.<\/li>\n<li>S\u2019il y a controvese sur l\u2019\u00e9tat des lieux, indiquer sur le document de remise des clefs l\u2019\u00e9tat constat\u00e9.<\/li>\n<li>Si les soucis s\u2019agravent, consulter imm\u00e9diatement votre avocat afin de savoir comment agir face \u00e0 chaque situation irr\u00e9guli\u00e8re. Cependant sachez que le locataire est doit prouver que le bien est remis en bonnes conditions et que la clef \u00e0 \u00e9t\u00e9 remise. Il ne peut affirmer que cela a \u00e9t\u00e9 fait sans preuves.<\/li>\n<\/ul>\n<h3>Point sp\u00e9cial locataire :<\/h3>\n<ul>\n<li>Si la <em>r\u00e9solution du contrat <\/em>se r\u00e9alise gr\u00e2ce \u00e0 une communication (1 mois avant habituellement), veillez \u00e0 ce que cette communication ou sa ratification soit \u00e9crite. Il n\u2019est pas rare qu\u2019elle soit orale et plus tard remise en question !<\/li>\n<li>Remettre les clefs en pr\u00e9sence d\u2019un voisin t\u00e9moin, afin d\u2019\u00e9viter tout soucis. Attention \u00e0 ce que le voisin ne soit pas un ennemi reconnu de votre propri\u00e9taire ni un locataire de celui-ci.<\/li>\n<li><em>Signer le document de remise des clefs<\/em> : le locataire est la personne qui doit prouver que les lieux sont remis en \u00e9tat. Ce document inclut un descriptif de l\u2019\u00e9tat des lieux au moment de la remise des clefs, et au mieux, des photos.
