{"id":342,"date":"2019-04-12T20:02:31","date_gmt":"2019-04-12T20:02:31","guid":{"rendered":"https:\/\/www.avocatfrancophone.com\/le-bail-locatif-en-espagne-les-clauses-abusives\/"},"modified":"2021-08-30T09:26:54","modified_gmt":"2021-08-30T09:26:54","slug":"le-bail-locatif-en-espagne-les-clauses-abusives","status":"publish","type":"post","link":"https:\/\/www.avocatfrancophone.com\/es\/le-bail-locatif-en-espagne-les-clauses-abusives\/","title":{"rendered":"Le bail locatif en Espagne: les clauses abusives"},"content":{"rendered":"\r\n<p class=\"wp-block-paragraph\">Une <em><strong>clause abusive<\/strong><\/em> est un article de contrat de bail qui est nul (et donc qui ne peut \u00eatre appliqu\u00e9) car il viole des droits et libert\u00e9s inali\u00e9nables et reconnus dans la Constitution Espagnole (arts 14 et suivants)\u00a0:<\/p>\r\n\r\n\r\n\r\n<ul>\r\n<li><strong> Articles discriminatifs de la personne<\/strong>, du sexe, de la race, religion, nationalite, etc mais \u00e9galement de l\u2019\u00e9tat civil.<br \/><em>Ex. : Un article qui indiquerait que cette location se destine uniquement aux personnes c\u00e9libataires serait abusif et donc nul.<\/em><\/li>\r\n<li><strong>Le droit \u00e0 l\u2019intimit\u00e9 :<\/strong> il est trop fr\u00e9quent qu\u2019une clause de contrat de bail oblige \u00e0 informer des personnes qui fr\u00e9quentent l\u2019appartement ou d\u2019informer si on forme un couple avec une tierce personne. Parfois la clause vous \u00aboblige\u00bb \u00e0 laisser entrer le bailleur chez vous pour v\u00e9rifier l&#8217;\u00e9tat de l&#8217;appartement. Ceci est \u00e9galement inconcevable, \u00e0 cet effet l&#8217;\u00e9tat des lieux se fait \u00e0 la remise des clefs*.<\/li>\r\n<\/ul>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">La seule information utile au propri\u00e9taire est celle relative au nombre de personnes y r\u00e9sidant, de sorte qu\u2019il puisse v\u00e9rifier qu\u2019il n\u2019y ai pas plus de r\u00e9sidents que ne le permette le certificat d\u2019habitation et de contr\u00f4ler les habitants <em>ayant-droit<\/em> aux effets du contrat de bail.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">Un bail ne peut vous interdire d\u2019avoir un enfant, mais il peut vous interdire d\u2019avoir des animaux domestiques qui causeraient <em>potentiellement <\/em>des odeurs, bruits, dangerosit\u00e9 ou d\u00e9g\u00e2ts dans l\u2019appartement. Mon opinion en ce sens est qu\u2019une clause correctement r\u00e9dig\u00e9e doit sp\u00e9cifier le type d\u2019animaux domestiques interdits. En effet, un bocal avec des poissons de dimension courante ne peut \u00eatre une cause de r\u00e9siliation de contrat.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\"><em>Ex.\u00a0: interdire les chiens et chats implique les effets de d\u00e9g\u00e2ts potentiels du parquet, murs et aux meubles, s\u2019il y a. On peut d\u00e8s lors poss\u00e9der un hamster ou autre animal dans une cage dans ce cas.<\/em><\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\"><em>Et en tout cas<\/em>, poss\u00e9der un animal sauvage (contraire \u00e0 animal domestique, donc) doit \u00eatre consid\u00e9r\u00e9 comme une activit\u00e9 illicite et potentiellement dangereuse susceptible de r\u00e9siliation de contrat de bail. Attention donc si vous poss\u00e9dez un boa, un loup ou autre.<\/p>\r\n\r\n\r\n\r\n<ul>\r\n<li><strong> Le contrat de bail ne peut emp\u00eacher l\u2019\u00e9tude d\u2019un instrument de musique<\/strong>, m\u00eame si celui-ci est potentiellement bruyant. A ces effets, c\u2019est la pratique qui sera importante\u00a0: si vous jouez un instrument hors horaires r\u00e9glement\u00e9s par l\u2019administration, vous pourrez assumer les amendes correspondantes, si l\u2019instrument a une puissance sup\u00e9rieure \u00e0 l\u2019acceptable m\u00eame aux heures de vie habituelle, \u00e9galement. Et de plus si le bruit provoqu\u00e9 est habituel, \u00e9lev\u00e9 et va \u00e0 l\u2019encontre de la biens\u00e9ance, votre bail pourrait \u00eatre r\u00e9sili\u00e9.<\/li>\r\n<\/ul>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">Ces m\u00eames risques de bruit existent si vous installez chez vous des \u00e9l\u00e9ments de reproduction du son tr\u00e8s puissants. Cependant d\u2019embl\u00e9e le contrat ne peut vous \u00e9liminer du droit de jouer un instrument ou de mettre de la musique.<\/p>\r\n\r\n\r\n\r\n<h2>Les droits que NE poss\u00e8dent PAS les locataires\u00a0:<\/h2>\r\n\r\n\r\n\r\n<ul>\r\n<li>De recevoir des informations sur le tenant et aboutissant des r\u00e9unions d\u2019assembl\u00e9e de copropri\u00e9taires.<\/li>\r\n<li>De conna\u00eetre les noms des membres de l\u2019assembl\u00e9e : pr\u00e9sident, tr\u00e9sorier, secr\u00e9taire.<\/li>\r\n<li>Sous-louer sans le permis expr\u00e8s du propri\u00e9taire : sous-location de chambre, d\u2019appartement complet, quelqu\u2019en soit le r\u00e9gime (r\u00e9sidence habituelle, saisonni\u00e8re, touristique).<\/li>\r\n<li>Profiter \u00e9conomiquement des sous-locations autoris\u00e9es : garder pour soi le gain obtenu.
